Does refinancing anytime during the first nine years get rid of the recapture tax provision?

Refinancing does not trigger recapture tax.  The recapture tax provision applies until you meet the nine year requirement or if you sell your home.  Please keep in mind recapture tax and the affordability period of IHCDA's down payment assistance guidelines are two different things.
